Unless otherwise stated, the texts, photographs, images, 3D images, animations, videos, drone footage, virtual tours, 360° panoramas, plans, illustrations, graphics, interfaces, logos, interactive elements, presentations and other content available on proview360.ch are protected by applicable intellectual property rights.
proview360 Sàrl holds the rights required to use such content or has obtained the necessary authorisations from the relevant rights holders.
Any reproduction, copying, downloading, modification, publication, distribution, commercial exploitation or reuse of such content beyond expressly authorised uses is prohibited without prior permission.
6.1 General principle
Unless otherwise agreed in writing, the commissioning and payment of a service does not automatically result in the complete assignment of intellectual property rights relating to works created or supplied by proview360 Sàrl.
Where proview360 Sàrl holds the necessary rights in a work, the client receives a non-exclusive licence to use that work in accordance with the conditions below.
This licence allows the client to use the work for the promotion and communication of the project for which it was commissioned.
6.2 Works covered
These provisions apply in particular, without limitation, to
real-estate photography
aerial photography
videos
drone photography and video
computer-generated and 3D images
3D animations and videos
architectural visualisations
virtual home staging
virtual tours and 360° tours
tours produced using technologies such as Matterport or 3DVista
panoramas
2D and 3D graphical plans
exploded views
layouts and sales materials
models, renderings and interactive content
graphic and multimedia materials
and, in general, any work produced as part of a mandate entrusted to proview360 Sàrl
6.3 Scope of the client’s licence
Subject to full payment of the relevant services and unless otherwise agreed in writing, the client may use the delivered work for the promotion, marketing and communication of the relevant project.
Such use is permitted in particular:
on the client's website
on the project's website
on real-estate portals
on social media
in digital campaigns
in paid advertising campaigns
on specialist platforms and media
in brochures, prospectuses and sales documentation on posters and printed materials
at exhibitions, trade fairs and events
in commercial presentations
in press releases and media publications
in the client's newsletters
and on any other medium intended to promote the relevant project
Unless otherwise agreed, this licence is granted without geographical or time limitation, provided that the use remains connected with the project or property for which the content was created.
Technical adaptations required for publication, such as resizing, reasonable cropping, compression or adaptation to the format of a social network or real-estate portal, are permitted provided that they do not distort or materially alter the work.
6.4 Resale and transfer prohibited
The right of use granted to the client does not constitute a transfer of ownership of the intellectual property rights.
Without the prior written consent of proview360 Sàrl, the client may not
resell a work produced by proview360 Sàrl
grant a sublicense to a third party
commercialise the work separately
transfer the work for use in another project
allow a third party to reuse the work for its own purposes or for another mandate
incorporate the work into an image bank, commercial library or product intended for resale.
The client may nevertheless provide the work to its agents, communication agencies, property managers, brokers, printers, real-estate platforms or other service providers where this is strictly necessary for the promotion of the relevant project.
Such third parties do not acquire an independent right of use and may not reuse the work for other projects or clients.
Proview
Unless expressly included in a quotation, offer, contract or order confirmation, delivery of the final work does not include source files or production files.
The following are therefore excluded from delivery unless otherwise agreed in writing:
RAW files
working photographic files
unedited video footage
editing project files
Photoshop or other layered working files
3D models and scenes
3ds Max, SketchUp or equivalent files
materials, textures and libraries
rendering or calculation files
virtual-tour source files
programming or configuration files
Matterport or 3DVista project files where they have not expressly been included in the service
and any other intermediate file used to produce the final result
Where a file normally considered a source file is expressly defined as a deliverable – for example a point cloud, plan file or model requested by the client – the provisions of the relevant quotation or contract shall prevail.
Unless confidentiality, an embargo or a written restriction has been agreed with the client, proview360 Sàrl reserves the right to use completed projects as professional references.

in commercial presentations
in quotations and reference documents
at exhibitions and events
in professional publications
in Proview360 advertising and communication campaigns
and in competitions, demonstrations and presentations of professional expertise
Where a project is confidential or has not yet been made public, proview360 Sàrl will comply with any publication restrictions or dates agreed in writing with the client.
Proview
Computer-generated images, architectural visualisations, 3D animations, 3D videos, virtual tours created from plans, interior design simulations and virtual home-staging content are primarily intended to facilitate the understanding, visualisation and promotion of a project.
Unless otherwise agreed in writing, such content constitutes illustrative and non-contractual representations.
Differences may occur in particular with regard to
colours
materials
textures
equipment
visually represented dimensions
furniture
decoration
lighting
vegetation
outdoor landscaping
surroundings
views
shadows and lighting conditions
and certain architectural or technical details
The completed, renovated or delivered project may therefore differ from the visualisations shown.
Plans, information, material references and other documents supplied by the client serve as the basis for production.
The client remains responsible for validating technical and commercial information before publication or use in connection with a sale, rental, authorisation, construction project or other commitment to a third party.
Visualisations produced by proview360 Sàrl do not replace contractual documents, execution drawings, architects’ plans, engineers’ plans or official project documentation.
Unless a specific level of accuracy has been expressly defined contractually, surveys, point clouds, models and plans produced by proview360 Sàrl must be used in accordance with the purpose specified in the relevant quotation.
Where legally or technically required, they do not replace official, cadastral, geometric or structural surveys or surveys carried out by an authorised specialist.
The client or the professional responsible for the project must verify critical dimensions before any manufacturing, ordering, alteration or execution of construction work.

Some services may incorporate software, platforms, music, fonts, models, libraries or other elements belonging to third parties.
Such elements may be subject to their own licences and terms of use.
The licence granted by proview360 Sàrl cannot confer on the client broader rights in third-party elements than those held by proview360 Sàrl itself.
These Legal Notices are governed by Swiss law.
Subject to any mandatory jurisdiction provided by law, disputes relating to the website or the interpretation of these provisions shall fall within the jurisdiction of the competent courts at the registered office of proview360 Sàrl in La Chaux-de-Fonds, Switzerland.

proview360 Sàrl may amend these Legal Notices at any time to reflect changes in its activities, services, technologies or applicable legislation.
The version published on the website at the time of consultation shall apply.
In the event of discrepancies between language versions, the French version shall prevail, subject to mandatory legal provisions.
